7 Operator qualifications
(1) A person must not operate a maritime ship station on frequencies in the ******VHF band****** unless the person:
(a) is qualified to operate the station; or
(b) is operating the station under the supervision of a person who is qualified to operate the station.
(2) A person is qualified to operate the station if the person holds:
(a) a Restricted Radio Operator's Certificate of Proficiency, Marine Radio Operator's Certificate of Proficiency or Marine Radio Operator's VHF Certificate of Proficiency; or
(b) qualifications recognised by the ACA as being equivalent to the qualifications mentioned in paragraph (a).
Yes the legislation is straight forward and in summary
- A VHF radio (itself) is covered by a class license as far as installation is concerned. There are no longer any fees or charges to do this.
- Operation of said radio comes under certificate of proficency requirements which requires a person to obtain that certificate

So its clearly now established that under current rules, you must hold a COP to operate any two way radio in the VHF band.
A technical question then .... is it within the rules to have a VHF radio installed in your boat, as long as you dont operate it? And assuming there is no other person on board who holds the VHF COP? _________________

"Radiocommunications (Maritime Ship Station - 27 MHz and VHF) Class Licence 2001" is the ***TITLE*** of the legislation/regulation.
The Class Licence contains regulations pertaining to both 27 Mhz and VHF. The section in question, 7, contains NO REFERENCE WHATSOEVER TO 27 Mhz. That much would be clear, by, you know, using that skill we call comprehension of the English language.

The word "operate" is subject to interpretation. It could be further defined in the Licence, defined elsewhere in legislation, or have been subject to interpretation in case law. Is turning on a radio, and listening to one of the specified frequencies in the VHF Band, "operating" the radio? Maybe. Note the training handbook for the COP contains plenty of material relating to the reception of transmissions.
In practical terms though, who is going to bust you? Nobody.
But why on earth would you want to have a VHF radio and not be able to operate it? I did my COP with the local coastal patrol radio guy and it took less than a day, was informal, informative, and at the end of the day everybody passed the exam for the full MROCOP. Our instructor didn't even give people the option of the more restricted MROVHFCOP, so we all became qualified to operate HF equipment as well.
And without it, how are you going to bounce a VHF transmission off the Mt Imlay repeater 80km into the Green Cape canyons back to VMR 201?
You will also need a COP to get a Maritime Mobile Service Identity (MMSI) so you can hook your GPS up to your DSC capable VHF radio and send an automated distress signal identifying your vessel and position with the press of a button.
