Hi Guys....sorry....I know this is boating forum...but I figure there are some smart people people here who can guide me.....I also own a boat!

We have a 2008 model VW Golf Pacific with tiptronic transmission. After 4 years and 6 months out of warranty....with only 29000 km's (wife driving to and from school each day) transmission has blown and dealer says I must pay to have rebuild at nealry 6k!!!!!!!!!!!!!!!

needless to say I am bleeding and will never buy another VW again...Golf are supposed to be good cars....but this is unbeliveable.....I have tried everyhting with dealer and VW australia but they are playing hard ball.....car has been serviced annually as per handbook requirements under warranty....do any of you know what recourse I might have?

Sounds to me like you have been white washed. At the end of the day if its out of warranty then it will be very hard to win with the dealer or manufactor. Hard to cop with only 29 klm but i cant see a way out of it even in a legal sence. Put it down to bad luck WW. Is there anyone else that can help with a S/H trany or maybe cheaper rebuild? I'd have a chat to Consumer Affairs if your in Vic.

Your statutory protection under the Competition and Consumer Act 2010 (formerly the Trade Practices Act) may provide some cover.

Even though you are outside the manufacturers warranty period the Act looks at how long an item could 'reasonably' be expected to last. 29,000km on a regularly serviced tranny would in my opinion not be satisfactory lifespan in most peoples view.

I'd do some research to determine whether there's a known weakness with that tranny to aid your case. Important to know if your a lone case or there are many instances.

6 months out of warranty is not long and with such low km's some sort of compromise on both sides would seem a reasonable solution if indeed you cannot get it replaced free.

I work in the motor industry and I can that this is extremley common for a DSG gearbox to completely pack it in, and Volkwagen know that too. There would be lots of warranty claims and lots of money spent by VW fixing and more commonly replacing these gearboxes. I would do exactly what you've done and talk too Volkswagen Aust. and plead you case, at the end of the day they are the ones who would be honoring you new gearbox and forking out the dollers for the labour to have it replaced. Good Luck.

Hey terry,

sorry to hear about that. I strongly agree with what Marty has said and had a mate have a win against Nissan last year with his hand grenade 3l patrol that detonated not far over 100,000. Unfortunatley Nissan, as VW have, played hard ball (they are very good at this stuff) and he had to take the matter to VCAT to get some joy. Let me know if you want his number to have a chat.

I'd also speak to a transmission shop to check the 6k.

Send an email/letter to Cars Guide they will often go into bat for a car just out of warranty also use internet forums (car ones) to get the message out there and to get vw's attention unfortunately kingy is right its a common problem. They have a few other issues as well that can cost a bomb to fix google problems/issues/troubles with vw golfs and see how much stuff comes up.

You can also give a write up on somewhere like Drive so if vw wont come to the party i'd be letting my feeling known in places like that.

Realistically your only chance is pleading with the warranty dept. at VW Australia.
Speak to some one senior, don't waste your time with just anyone who answers the phone as they have trained people rejecting these claims on a daily basis.
I think you may have a chance for partial warranty, a manufacturer will often pay for parts only.
The dealer is only a middle man, don't even bother there, they will put in a claim and leave it at that, regardless if it gets rejected or accepted, they really don't care either way. Most of the time a decision for extension on warranty is calculated by a computer, you really do need to get the human element involved and plead the low kms and 6 month over warranty expiry date.
