heres a bit of insider info on insurance... (and i will keep away from insurance terms to make it easy to understand)

the insured party is liable for any claim if the insured party is aware of an issue that may cause an accident.

example- storm hits your area and the big gum tree out the front dosnt fall... but probably will in the next week or 2. had it fallen on ur roof during the storm, u could claim. because it hadn't and it is a risk to your house or people who walk under it- the onus is now on you as the home owner.

in this case, the council or whomever is overall responsible for the ramp (I am a season ticket holder @ warneet) is aware of the very real risk of injury or accident caused by the state of the ramp, then the insurance will not cover it.

how can we ensure that something will happen? the insurer needs to be made aware of the state of the venue, include photos, and they will chase up the coucil etc, basically informing them that their insurance is null and void- due to not taking reasonable precaution to prevent an accident.

good luck to you boys fighting for us, i hope i have been of some help.
cheers
BK

Great stuff, who donated the Bob cat to help out (who ever it was - good on ya happy-fish.gif )
Dom ( The new owner) is definately applying the pressure on the nuff nuff parties responsible for the upkeep of the foreshore (seen or should I say HEARD him first hand (Doesn't pull any punches)
Hopefully, the extra attention on this site (I forwraded the direct link to the MP's and some others who are to be named in the media article that have failed to act so far even after seeing it first hand) is doing some good, BUT, not sure, BUT I bet that bob cat is being donated by a concerned fisho and not the DSE or committeee, Either way, at least the ball is rolling.
I guess

If the bobcat operator is a private operator and not working for the council would there be any liability issues if someone is now hurt on any of the works he has performed. Very risky i would of thought but good on him for doing something.

It is great to see the efforts that people are willing to go to help, BUT you only need to look at the situation that happened at Licola when they were cut of by the flood that they had. The locals sick of inaction took matters into there own hands and rebuild sections of bridge and road and got into some serious shit over it from government departments. Not knocking the work i think it is great, just worried about the ramifications for them.
